			<content:encoded><![CDATA[<p>On Saturday January 28, the City of Vancouver will hold a workshop for stakeholders with an interest in the community plan process for the West End.</p>
<p>WEN will be represented at the workshop and a total of twenty-one stakeholder groups have confirmed attendance including representatives from organizations such as St. Paul’s Hospital, the West End Seniors’ Network, the Urban Development Institute and Gordon Neighbourhood House.</p>
<p>We believe that WEN has the potential to play an important role in the planning process for the West End by raising awareness of the issues, promoting meaningful engagement, and encouraging education on relevant topics, such as zoning, planning and the development approval process.</p>
<p>WEN’s petition on “no rezoning without a comprehensive plan” stated that:<br />
“I request in the event of considering general or site-specific land use and/or West End zoning changes, that these include meaningful consultation with residents, protect existing neighbourhood liveability, and respect/maintain the character of the neighbourhood. We need a comprehensive plan, not site-by-site rezoning.”</p>
<p>WEN will be encouraging meaningful consultation with residents calling for protection of existing neighbourhood liveability and for the need to respect and maintain the character of the neighbourhood.</p>

<p>A critical development project was presented at a quietly-organized open house about a controversial development project being proposed for the corner of Kingsway and East Broadway. This project is significant for all taxpayers, neighbourhoods and citizens, as it reveals serious problems at the nexus of community planning processes, developers, the City’s Planning Department, and the city’s housing-related policies. It may have many lessons  for the West End.</p>

<p><strong>Residents Association Mount Pleasant</strong> (<a title="rampvancouver.com" href="http://rampvancouver.com/" target="_blank">rampvancouver.com</a>) provides extensive info and analysis of the project.</p>
<p>The West End has begun a million-dollar community planning process, with an invitation-only workshop to finalize the terms of reference to be held on January 28. And the West End is reeling from three major STIR (developer incentives to build market-priced rental housing) projects &#8212; one approved and two still in the pipeline.</p>

<p>Millions of tax dollars and thousands of hours of City staff and community volunteer time were spent on a community planning process to create the Mount Pleasant Community Plan, approved in 2010. New planning processes have just begun in four areas (Downtown Eastside, Grandview-Woodland, Marpole, and the West End). This Rize project is quite outside the bounds of what was considered acceptable by the community (in input to the community plan, and in earlier feedback on this specific proposal). It was to include rental apartments, but the proposed number has been steadily reduced and just this week was reduced to zero. They were to have been under the Short Term Incentives for Rental Housing (STIR) program, which was adopted with virtually no public consultation in 2009.</p>
<p>STIR has been attacked for many reasons, including its legal basis (search for “STIR” on <a title="WestEndNeighbours.ca" href="http://www.westendneighbours.ca/" target="_blank">WestEndNeighbours.ca</a> for details). City Council allowed STIR to expire on December 15. In the West End, a major rezoning under the STIR program was approved in 2009 at Bidwell and Davie Streets (excavation of the site is under way this week). A second one at Beach and Harwood is expected to go to public hearing soon. And another at 1401 Comox is expected to go before a public open house soon. <p>Anyone interested in how the City is currently functioning with regards to land use planning should follow this case in the coming days and weeks.</p>

<p>Dear Neighbours,</p>
<p><strong>West End Neighbours</strong> hopes that you all enjoyed a wonderful time with family and friends over the holidays, and wishes you a great year in 2012. Much happened in our community in 2011. The West End became a stronger community thanks to all who contributed in various ways in the past year.<span id="more-4444"></span></p>
<p>The WEN petition, signed by almost 13,000 people, calls for &#8220;No rezoning without a comprehensive plan.&#8221; In the spirit of that petition, we will continue to work with many others to encourage civic engagement and ensure that the West End continues to be a great place to live for everyone.</p>
<p>Below are updates on some key issues, each one part of a bigger story. For more information on most of these, please visit our website or CityHallWatch and search for the key word indicated.</p>
<p><strong>West End Planning Process: Coming Soon</strong></p>
<p>In July of 2011, City Council agreed to move forward with a comprehensive community planning process for the West End. This process resonates with the demands of our petition, and having a plan in place should help guide the future of the West End in an organized fashion rather than creating uncertainty through the current &#8220;spot rezoning&#8221; approach taken by the City. City Staff have recently embarked on the preliminary stages of the planning process, including establishing the draft terms of reference for the plan.</p>
<p>An invitation-only workshop will be held on January 28 for West End and citywide community organizations. WEN will be present, and welcomes comments from residents in advance of this workshop. The planning process is the community&#8217;s opportunity to have a hand in determining the future of the West End, so WEN encourages all West End residents to make themselves aware of the planning process and the opportunities for public input to this process.</p>

<p><strong>STIR Program: Dead (Or alive?)</strong></p>
<p>On Dec. 15 the &#8220;Short Term Incentives for Rental Housing&#8221; (STIR) program to encourage the creation of market-priced rental units came to an end. To WEN’s knowledge, the City made no official announcement, and the end of STIR appears to have been completely missed by most media. But in December, Councillor Stevenson said that &#8220;the program as we know it has to finish on that date,&#8221; when answering questions to Xtra!West Reporter Shauna Lewis, who has given West End development issues some of the most consistent and accurate coverage in the past few years.</p>

<p>City staff will likely be assessing the program, reporting to Council, and making recommendations for follow-up to the STIR program. Controversy has surrounded STIR citywide due to the link between STIR and disproportionately large rezoning proposals that provide windfall benefits for developers at the expense of residents, taxpayers, and the host neighbourhoods. WEN announced in November its findings that the STIR program is legally flawed and that the STIR program as it has been applied can be legally challenged. The City has not yet responded.</p>

<p>The program was adopted in July 2009 with virtually no public consultation. We believe the City should look at fairer and more effective ways to protect and enhance both market and affordable rental housing options. In the West End, the Bidwell/Davie, Beach Towers, and 1401 Comox projects have all come forward in their current form due to the STIR program. A 35+ storey tower proposal may come forward for the site of the Davie Village Community Garden on Burrard/Davie, although it is unclear whether this will be a rental proposal. The City Planning Department indicated that it would entertain proposals accepted before the December 15 deadline, so the public should watch for news about proposals &#8220;in the pipeline.&#8221;</p>

<p><strong>West End Mayor&#8217;s Advisory Committee (WEMAC): Big influence on West End planning</strong></p>
<p>This advisory committee reporting directly to the Mayor was created as a &#8220;pilot&#8221; for other neighbourhoods in the City and was to end &#8220;when a West End planning process is formally initiated by the City of Vancouver&#8217;s Planning Department.&#8221; That process is now under way, but at its meeting on November 22, WEMAC passed a motion recommending to the Mayor that a &#8220;permanent&#8221; West End Advisory Committee (WEAC) be created (see minutes on City site).</p>
<p>WEMAC also decided not to answer but to forward to the Mayor a letter from WEN former president and current director, Randy Helten requesting that WEMAC hold &#8220;a public meeting as soon as possible (within the year 2011) in the West End, well-advertised in advance, to describe its activities to date, current status, and future prospects.&#8221; The letter was stimulated by the fact that WEMAC held no public meeting within the West End for residents, though its official work appears to now be completed.</p>
<p>WEMAC and the influence of its recommendations on City policy are important to continue watching.<br />

<p><strong>WEMAC&#8217;s &#8220;Rezoning Application Community Priorities Scorecard&#8221;: Magic numbers?</strong></p>
<p>At the November 22 meeting WEMAC also approved their own &#8220;Rezoning Application Community Priorities Scorecard.&#8221; The scorecard is WEMAC’s input to the City&#8217;s Planning Department to evaluate rezoning applications. It could influence staff recommendations and Council considerations regarding major land-use decisions.</p>
<p>The scorecard has not been formally evaluated independently, but a West End resident with a professional background in surveys did address City Council in September pointing out flaws in the survey design upon which the scorecard is based. For example, the final WEMAC survey reported that the objective &#8220;Maintain Height Guidelines&#8221; was not a priority concern for survey respondents. Based on WEN’s review of the actual survey findings, in fact, respondents did indicate that maintaining building height guidelines was indeed among the top priorities of respondents. It appears WEMAC did correct this error in the final scorecard, although the official report to Council has not to date been revised on this point.</p>

<p><strong>Specific site updates</strong></p>
<p><strong>Beach Towers: Next up – big public hearing for rezoning</strong></p>
<p>The Heritage Commission and Urban Design Panel have given their blessing on the latest proposal. This is the first case of WEMAC&#8217;s Rezoning Application Community Priorities Scorecard being applied. All that&#8217;s left on this STIR project rezoning is a staff recommendation and Council referral to a Public Hearing. WEN encourages residents to read up on this case and prepare to speak when the Public Hearing is scheduled.<br />

<p><strong>1401 Comox (former site of St. John&#8217;s Church): Flat land but tower soon?</strong></p>
<p>This is another controversial rezoning application made possible by the STIR program. St. John&#8217;s was bulldozed last July, leaving a fenced hole in the ground and scaffolding to protect trees on the property boundary. The only public information available on current status is from Xtra! (link) quoting Matt Shillito (senior city planner) saying, &#8220;I understand from the rezoning planner that the applicant [Henriquez/Westbank/Peterson] has recently submitted a revised proposal, which seeks to respond to concerns raised by the community. We expect some public information meetings to be held on these revised plans early in the new year.&#8221;</p>
<p>On December 22, the city&#8217;s website was updated with new information: (http://vancouver.ca/commsvcs/planning/rezoning/applications/1401comox/index.htm) The newly revised application is still asking for the same height (22 storeys) and a huge increase in floor space ratio from the current permitted maximum of 1.5 to a proposed 7.14, but the community space for Qmunity and Gordon Neighbourhood House has been removed from the proposal. An open house is expected in February. A Public Hearing would follow sometime later.</p>

<p><strong>1241 Harwood (Legg Residence, tulip tree site): Heritage demolition, tree saved (?), 17 storey tower coming</strong></p>
<p>The revised proposal for this site was treated by the City as a development application, permitting less public input than a rezoning or a heritage revitalization agreement. In December, the Development Permit Board approved (by a vote of three senior-level members of City staff) the application to construct a new 17 storey tower with the preservation of the tulip tree and demolition of the Category &#8220;A&#8221; Legg House on the property. Some West End residents are investigating further possible responses to the approval by this Board.</p>

Learning from the disturbances resulting in numerous complaints by Westbank&#8217;s demolition of St John&#8217;s Church last June/July, Millennium has created a web page to update neighbours about progress with the demolition and construction of this 21-storey tower. The City is currently planning a major project to develop the &#8220;Comox-Helmcken Greenway&#8221; through the West End. Consultation was done in the fall of 2011, and the City says that as the design is not yet known, costs are not yet known. <p><strong>Regional News: Metro Vancouver</strong><br />
Metro Vancouver (the GVRD) is a large regional body covering 24 local governments and about 2 million people, costing every family over $500 per year in taxes, and having considerable influence on land use and development in the region. Within the 1.5 years, Vancouver must adopt a &#8220;regional context statement,&#8221; a parcel-by-parcel land-use plan for the City, which could have big implications for Vancouver, including the West End, under the 30-year Regional Growth Statement adopted in July 2011. Watch for more news on this.</p>
<p>In December a new chair of the board of directors was elected by secret ballot (Port Coquitlam Mayor Greg Moore) and vice-chair (Vancouver Councillor Raymond Louie). Vision Vancouver mayor and councillors took all six spots representing Vancouver citizens on this board.</p>

In the end, the voting members of the DPB gave &#8220;conditional&#8221; approval for the proposal for a 17-story tower at 1241 Harwood, which will result in demolition of an A-listed heritage building, and may also put the giant Tulip tree at risk.</p>

<p>In a complex case like this, the public is forced to trust City Council and City staff to look after the community and public interests. Yet we do know that some people are unhappy with the performance of Council and the DPB and may be looking for further options and actions on this case. Under the Code of Conduct, City Hall is to put the public interest first and foremost. This particular project is an interesting case, as its multi-year history shows the roles of many players in the development process, and leaves one to wonder if City Hall (including elected officials and public servants) is able to fairly balance the interests involved. The system in Vancouver leaves considerable discretion to the Director of Planning and the Planning Department in applying zoning and development guidelines. People can generally accept change if rules and guidelines are applied in a fair manner, but is the public getting a fair deal? That as an open question.</p>

<p>The applicant wants members of the DPB to approve the construction of a 17 storey condominium tower. When making this decision, Board members consider the input of the Vancouver Heritage Commission, the Urban Design Panel and the concerns of the residents and visitors in the West End.</p>
<p><strong>If you wish to influence changes to this application, you must send in individual written submissions by December 9</strong><strong>th</strong><strong> if possible and/or attend the meeting on December 12</strong><strong>th</strong><strong> to make a short speech (no more than 5 minutes long). </strong></p>

			<content:encoded><![CDATA[<p align="left">WEN issued a media release about the STIR program today. West End Neighbours (WEN) has identified concerns with the legal framework of the controversial Short Term Incentives for Rental (STIR) housing program and calls upon the City of Vancouver to discontinue the program.</p>
<p>In examining the STIR program and its legal basis, it is WEN’s contention that:</p>
<ol start="1">
<li>The <em>Vancouver Charter </em>does not give the City of Vancouver the authority to waive Development Cost Levies (DCL’s) for <em>market</em> rental housing.</li>
<li>The City of Vancouver has improperly delegated Council’s legislative authority by granting the City Manager the discretion to determine the affordability of for-profit affordable rental housing development proposals in the manner that it has done.</li>
<li>The definition of “affordable” under the by-law is too vague and uncertain to be enforceable.</li>
</ol>
<p>WEN considers that its position is legally supportable. Based on these conclusions, WEN requests that the City of Vancouver cancel the STIR program, and refrain from creating similar incentive packages that would provide additional development projects with inappropriate DCL waivers and other benefits. The incentives offered are resulting in deficiencies estimated at a minimum of $20,000 per rental unit that must be made up by other taxpayers. The benefitting projects are damaging livability and neighbourhood character to create market rental housing &#8211; public money and City Council’s discretionary zoning powers should not be used in this way.</p>
<p>&#8220;<em>The legal framework of STIR looks flawed and Development Cost Levies for these developments appear to be waived without proper authority. The program is creating expensive market housing rather than helping to address the housing affordability challenge, so it&#8217;s time for the City to scrap this program,</em>&#8221; said Emanuel Pereira, a resident of the West End.</p>

			<content:encoded><![CDATA[<p>While voters&#8217; attention is focused on the municipal election this week, and with affordable housing as a primary issue, a proposal to rezone the West End&#8217;s waterfront heritage site Beach Towers is once again before two City-appointed advisory committees.</p>
<p>Under the controversial STIR program (Short Term Incentives for Rental), additional buildings at Beach Towers would be subsidized luxury rental, allowing the developer to avoid more than $1.19 million in development cost levies, as well as qualifying for reductions in property taxes.</p>
<p>Despite STIR&#8217;s mandate to &#8220;seek affordability through finishing, size, location&#8221; this proposal requests 133 waterfront apartments, including a number of high-end Beach Avenue townhomes.</p>
<p>&#8220;<em>Beach Towers is a class-A heritage site and a prime example of post 1960s modernist architecture with over 1000 residents currently living in the four towers. If rezoning is approved under STIR, we would be subsidizing luxury waterfront rental and condoning misapplied density. This isn&#8217;t the type of &#8216;affordable&#8217; housing Vancouver needs&#8221;</em>, said Sarah Isaacs, West End resident.</p>
<p>Both the Vancouver Heritage Commission and Urban Design Panel are being quickly assembled this week to review the third iteration of the proposal to rezone and add density to this heritage site. Despite previous rejections by the Vancouver Heritage Committee and Urban Design Panel, a new proposal submitted on November 4, 2011 made no significant revisions and requested an even greater increase in density.</p>

<p>Talk show host, Pia Shandel, will moderate the event. The debate is open to all candidates for city council.  The format is designed to get the most out of the candidates, include audience participation, and be fun AND informative. It will not be the usual Q&amp;A, but folks will be able to submit questions prior to the debate through comments on the WERA website <a href="http://wera.bc.ca/" target="_blank">here</a>.</p>

<p>Some suggest this city needs to improve its standards of public safety and comfort (substantially) when it comes to creating the least amount of disruption during demolition and construction in existing neighbourhoods. Take for example the daily seismic tremors for a month and a half that were felt for blocks around the demolition of St. John&#8217;s Church at 1401 Comox this past summer. That was due to the demolition company removing re-bar from concrete on site in the middle of a dense West End residential neighbourhood, rather than hauling it away to deal with it in a less disruptive location, despite numerous complaints to city councillors.</p>

<p>Meanwhile others are nodding to Maxine&#8217;s ghost, who can&#8217;t be happy to have been renovicted out of the West End as her newly demolished building at 1215 Bidwell leaves only the façade as some bizarre superficial homage to heritage. Now homeless, it would seem a fitting expression of her dissatisfaction for the gutting of her former place of business, that on the preceding night, the hoarding succumbed to the blustery wind, and the injustice felt by this spirit laid bare for all too see.</p>
<p>Or the city&#8217;s building department could try setting appropriate standards for demolition work. We are three weeks from the next civic election and Vision Vancouver, who&#8217;s largest donors are our city&#8217;s land developers, have been campaigning on a platform of &#8220;safer, more livable neighbourhoods&#8221;. They could start with the basics. As the incumbent party holding a majority on council during which rezoning uncertainty at multiple sites and much disruption and antagonism in the West End was defined during their term on council, it&#8217;s difficult to know practically what that could possibly mean.</p>
